ОНЦГОЙ АЛБАН ТАТВАРЫН ТУХАЙ ХУУЛЬД ӨӨРЧЛӨЛТ ОРУУЛАХ ТУХАЙ ХУУЛИЙН ТӨСЛИЙН ҮЗЭЛ БАРИМТЛАЛ
 
            Нэг.Хуулийн төсөл боловсруулах үндэслэл, шаардлага
 
 
Төлбөр тооцоог үндэсний мөнгөн тэмдэгтээр гүйцэтгэх тухай хуулийн 4 дүгээр зүйлийн 4.2, 4.3 дахь хэсэгт “улсын болон орон нутгийн төсөвт төлөх аливаа төлбөр тооцоо, хураамж, шимтгэл, хариуцлагын хэмжээг тодорхойлохдоо зөвхөн төгрөгөөр илэрхийлнэ” гэж заасны дагуу гадаад валютаар ногдуулж байгаа татварын төрлийг үндэсний мөнгөн тэмдэгтээр тогтоох шаардлагатай байна.
Түүнчлэн сүүлийн жилүүдэд эдийн засгийн нөхцөл байдлаас шалтгаалан ам.долларын ханшийн хэлбэлзэл нилээд нэмэгдэж байна. Үүнээс үүдэн ам.долларын ханш өсөх үед аж ахуйн нэгжүүдийн татварын ачаалал нэмэгддэг бол эсрэгээрээ ам.долларын ханш буурах үед төсвийн орлогын эх үүсвэрт сөрөг нөлөө үзүүлж байна. Энэ нөхцөл байдлыг харгалзан үзэж, ам.доллараар тогтоосон онцгой албан татварыг төгрөгөөр тогтоох зорилгоор Онцгой албан татварын тухай хуульд өөрчлөлт оруулах тухай хуулийн төслийг боловсруулсан болно.
 
 
 
Хоёр. Хуулийн төслийн ерөнхий бүтэц, зохицуулах харилцаа, хамрах хүрээ
 
            Хуулийн төсөл нь 4 зүйлтэй байх бөгөөд 1, 2 дугаар зүйлд ам. доллараар илэрхийлсэн дүнг төгрөгт шилжүүлэхээр, 3 дугаар зүйлд онцгой албан татварыг ногдуулахдаа Монголбанкнаас тогтоосон албан ханшийг үндэслэх заалтыг хүчингүйд тооцохоор, 4 дүгээр зүйлд хууль хүчин төгөлдөр болох хугацааг тус тус заасан.
 
 
 
            Гурав. Хуулийн төсөл батлагдсаны дараа үүсч болох нийгэм, эдийн засгийн үр дагавар
 
Хуулийн төсөл батлагдсанаар аж ахуйн нэгжүүдийн татварын дарамт өсөхгүй бөгөөд тэдгээрийн төлбөл зохих татварын хэмжээ болон төсөвт төвлөрөх татварын орлого ханшийн хөдөлгөөн дагаж хэлбэлзэхгүй тогтвортой болох юм. Улмаар аж ахуйн нэгжүүдийн хувьд төсөвт төлөх татварын хэмжээг тооцох, татварын тайлан гаргахад илүү хялбар байна.
 
Нөгөө талаас Төлбөр тооцоог үндэсний мөнгөн тэмдэгтээр гүйцэтгэх тухай хуулийг  хэрэгжүүлж, хууль хоорондын уялдааг хангаж ажиллахад чухал үр дүнтэй юм. 
 
 
            Дөрөв. Хуулийн төсөл нь бусад хуультай хэрхэн уялдах, уг хуулийг хэрэгжүүлэхтэй холбогдон цаашид шинээр боловсруулах буюу нэмэлт, өөрчлөлт оруулах, хүчингүй болгох хууль тогтоомжийн талаар
 
             Хуулийн төслийг Монгол Улсын үндсэн хууль, Төлбөр тооцоог үндэсний мөнгөн тэмдэгтээр гүйцэтгэх тухай хууль, Татварын ерөнхий хуулийн хүрээнд боловсруулсан бөгөөд хууль хэрэгжүүлэхтэй холбогдуулан шинээр боловсруулах буюу нэмэлт өөрчлөлт оруулах, хүчингүй болгох хууль байхгүй болно.
