Монгол Улсын Их Хурлын дарга З.Энхболдод өнөөдөр /2014.11.25/ УИХ-ын гишүүн, Төрийн байгуулалтын байнгын хорооны дарга А.Бакей, УИХ-ын гишүүн С.Дэмбэрэл нар “Монгол Улсын Хүний Эрхийн Үндэсний Комиссын тухай хуульд нэмэлт, өөрчлөлт оруулах тухай” хуулийн төслийг өргөн барив.

 Монгол Улсын Үндсэн хуулийн Хоёрдугаар бүлэгт Хүний эрх, Эрх чөлөөг хуульчилан заасан нь Олон Улсын хүний эрхийн гэрээ, конвенци дэлхий нийтийн жишигт хүрсэн алхам болсон бөгөөд манай улс 1961онд НҮБ-ын гишүүнээр элсэн орж, Хүний эрхийн түгээмэл тунхаглалын /ХЭТТ/ үзэл санааг дэмжиж улмаар Иргэний болон улс төрийн эрхийн тухай олон улсын пакт, Эдийн засаг, нийгэм, соёлын эрхийн тухай олон улсын пактад 1974 онд нэгдэн орсноос хойш хүний эрхийн талаарх 30 гаруй гэрээ, конвенци, протоколд нэгдэн орсон буюу соёрхон баталжээ.

 2000 онд Монгол Улсын Хүний эрхийн Үндэсний Комиссын тухай хуулийг баталснаар олон улсын гэрээ, конвенци, Монгол Улсын хууль, тогтоомжийн биелэлтэд хүний эрхийн чиглэлээр хяналт тавьж, судлан дүгнэх үүрэгтэй үндэсний байгууллага болох Хүний эрхийн Үндэсний Комиссыг 2001 онд байгуулав. Сүүлийн 14 жилийн турш нэмэлт, өөрчлөлт, ямар нэгэн засваргүйгээр хэрэгжүүлж ирсэн энэхүү хуулийг "НҮБ-ын Парисын зарчмуудаар баталгаажуулсан наад захын зарим хэм хэмжээг хуульчлаагүй” хэмээн олон улсын зүгээс одоог хүртэл шүүмжлэлтэй хандаж ирсэн. Монгол Улсад хүний үндсэн эрх, эрх чөлөөг Үндсэн хуулиар олон улсын нийтээр хүлээн зөвшөөрсөн хэм хэмжээний түвшинд өргөмжилсөн хэдий ч түүнийг хангах нийгэм эдийн засгийн нөхцөл, эрх зүйн таатай орчин хараахан бүрдэж амжаагүй байгаа билээ. Ялангуяа хүний эрхийн талаарх хууль тогтоомжийн хэм хэмжээг амьдралд хэрэгжүүлэх шатанд багагүй бэрхшээлүүд учирч цөөнгүй зөрчил гарч байгаа нь нийтэд ил болсон. Иймд хууль тогтоомжийн хэрэгжилтийг хангаж, хэрэгжүүлэх явцад гарч байгаа тэдгээр зөрчлийг бууруулахын тулд хууль сахиулагчдад нөлөөлөх, эрх нь зөрчигдсөн иргэдийн эрх ашгийг хамгаалах явцад хүний эрхийг хамгаалах, дэмжих төрийн механизмыг боловсронгуй болгох, ХЭҮК-ийн хараат бус, бие даан ажиллах чадавхыг бэхжүүлэх нь зүйтэй гэсэн үндэслэлээр уг хуулийн төслийг боловсрууллаа хэмээн хууль санаачлагч мэдэгдсэн болохыг УИХ-ын Тамгын газрын Хэвлэл мэдээлэл, олон нийттэй харилцах хэлтсээс мэдээлэв.
