УИХ-н гишүүн С.Дэмбэрэлийн санаачилсан ӨРСӨЛДӨӨНИЙ ТУХАЙ МОНГОЛ УЛСЫН ХУУЛЬД НЭМЭЛТ ӨӨРЧЛӨЛТ ОРУУЛАХ ТУХАЙ ХУУЛИЙН ТӨСЛИЙН ТАНИЛЦУУЛГА БА ТӨСӨЛ

Нийтэлсэн: 10 жилийн өмнө Үзсэн: 1137

УИХ-аас 2010 онд“Өрсөлдөөний тухай” Монгол Улсынхуулийн шинэчилсэн найруулагыгбаталсан.  Энэхүү хууль хэрэгжижэхлээд өнөөг хүртэлх хуагцаандбизнес эрхлэгчдийн санал хүсэлтшүүмжлэлд багагүй өртдөг хуулийннэг  боллоо.   “Өрсөлдөөний тухай”хууль нь бизнесийн үйл ажллагаандоролцогч аливаа этгээдүүдийн тэгшэрх, шударга өрсөлдөх зарчимдүндэслэж, бизнесийн таатай орчингбүрдүүлэхэд чухал ач холбогдолтойхууль билээ.  Одоо мөрдөгдөжбайгаа хууль нь нэр томьёоны хувьдойлгомжгүй,  мөн ШӨХТГ-ын эрххэмжээг  өргөжүүлсэн, төр болоннийтийн өмчит аж нэгж байгууллагыг хамруулаагүй, мөн төрийн оролцоог  хангасан зэрэг  зах зээл,шударга өрсөлдөөнд харш олон заалтууд байна.  Иймээс хуулийн эдгээр заалтуудыг засчнайруулах,  зах зээлийн зарчим, бизнесийн үйл ажиллагаанд оролцогчдод харилцан тэгш эрх,боломжийг олгох эрх зүйн орчинг бүрдүүлж өгөх шаардлагатай байна.

            Хуулийн төслийг боловсруулахдаа  хуулийг хэрэгжүүлэх явцад гарсан  алдаа дутагдал,доголдлын талаарх  бизнес эрхлэгчид, аж ахуй нэгж байгууллагуудын зүгээс гаргасан саналхүсэлт, зөвлөмж,  мөн  салбарын  чиглэлээр байгуулагдсан 50 гаруй зөвлөл болоод мэргэжлийнхолбоодын  гаргасан санал хүсэлт, дүгнэлтэд үндэслэн боловсруулсан болно. Хуулийн төслөөр“Өрсөлдөөний тухай” хуулийн 15 орчим хувьд, нэмэлт өөрчлөлт, хасалт хийсэн болно.

            Хуулийн төслийг боловсруулахдаа Монгол Улсын Үндсэн хууль, бусад хууль тогтоомжоорзаасан үндсэн зарчим удирдлага болгон бизнесийн ёс зүй, худалдааны зан заншлийн хэм хэмжээндтулгуурлан эдгээр зарчмуудын ялгаатай талыг уялдуулах, нийцүүлэх чиглэлийг баримталсан.Түүнчлэн хуулийн төслийг боловсруулахдаа одоо хэрэгжиж байгаа хуулийн үзэл баримтлал, өөрийнорны практик, бусад орны туршлагыг судлан үзсэн.
